Default RIAA On A Roll

Let’s face, the courts have been very, very good to the media conglomerates of late, what with last weeks legal victories in Texas and the Supreme court. Today brings news of another out of the park home run for the boys of team RIAA. It’s official, Verizon has to cough up the name of the customer who’s allegedly uploading all those hundreds and hundreds of files to Kazaa. Assuming it’s upheld on appeal, the RIAA can now issue blanket subpoenas to hundreds – or thousands of file sharing users with little more effort than writing one letter to an ISP.

well, that's a bit chilling, isn't it?

i didn't see any mention of Verizon's reaction - certainly hope they intend to appeal.

edit: ah, there we go...a little more in this article about Verizon's reaction. i would hope this has a reasonable chance of being overturned on appeal...but as with the Eldred case, the question may not be whether it is right or wrong (to be able to subpeona an ISP subscriber without a judge's ok) - only that current law (the DMCA) allows it to be done this way.

it is probably gonna take someone who gets served with said subpoena, together with some deep pockets and/or interested parties (the EFF et al), to really challenge this invasive and draconian provision of the DMCA and test it's constitutionality (or lack thereof)

Fuck, i have Verizon right now! fuck!..... shit!

I better clear my kazaa folder and shit... err whatever.... G-dammit... looks like i won't be staying with them

EDIT -- *reads article* well i guess they're arguing about it for now... so maybe i should use a dif. p2p.

i've been thinking... the anarchy this will cause doesn't suck at least...

i mean, if this holds up... then i can go to a court and, i think, fill out some form. a clerk stamps it or something. i present that form plus my "proof" to an isp. the isp now must give me the name and address of that ip number.

and when i say i, i mean me. i can do this as a citizen; as long as i claim i have a copyright being violated, hehe.

so... trolls are gonna be FUCKED when this happens. unless they rode in on a proxy of course; hehe.

but still; it's going to be a different internet when your identity is available through a small amount of trickery and a few hours in your local court building.
