great post from lessig, theknife, thanks for the heads-up. after finishing his book i was pleased to see him in front of the us supreme court arguing for actual limits, even if he feels he's not up to the task. the internet is i feel at least as important as gutenberg - if not more so, and must not be co-opted any longer by commercial special interests.
after reading his post and the following line - "Please, in the spirit of the best of this sphere, carry these arguments along, and correct the many mistakes I have made. But I need a night when the limits of this lawyer don't keep this lawyer awake." i realized what a wonderful and modest man he is as well. from peer-to-peer to webcasting and the dmca to television, this is the first of many crucial and important copyright fights to come, but regardless of those outcomes it's a fine thing being surrounded by so many astonishing individuals, ones who care so deeply about the rights of all people to communicate amongst themselves. - js. |

I loved this part:

It's too bad we have to wait until spring for the decision. But the case has been argued for four years now, I guess waiting an other five months isn't a big deal.

It's a brilliant article! I've read a few interviews with Lessig on /. but this gives me an inside view on the dynamics, ambiguities & flaws of the American constitution. I hope that they do fix it. If they don't, what kind of example will the U.S. be setting for the rest of the world? Slavery is illegal just as long as you don't own the copyright?

i read an earlier article re lessig posted at info anarchy on this case; i finally remembered where I heard a lot of these issues before (stimulating innovation by protecting those who innovate vs. stimulating innovation by allowing derivation, etc.).
Hip-hop. Gilbert O'Sullivan vs. Biz Markie. in the early years of rap, lots of cases re samplng of old records by new ones; eventually the copyright holders pretty much got their way, if I'm not mistaken. hope it doen't happen again. |

i just got an email from lessig (he's outside the us today) and he is heartened by the support we're showing. he says it makes it all "worth doing"! you never know how far a kind word or a note of thanks can go, especially in situations where monetary renumeration is not a goal. keep encouraging the people in this fight and in the future you can look back on it as your victory and the part you played in it.
