Do you get good search results on 3.22? How long until enough switch to 3.3 before 3.22 is unusable? It contains some interface improvements WRT multi-source searches and downloads. You can always uninstall it and go back to 3.22.
BTW, FrontCode is becoming more and more opaque. They used to have a forum that they got rid of when 2.6 came out (or even earlier?). They used to have a bugs page (granted, it always said "no bugs"...) and that's gone as well. They keep saying there is no spyware, but really, no one seems to know who these guys who make WinMX are. Are there any interviews on Slyck?
