you would not. the canadian copyright board generally recognises the rights of canadians to copy content and now to download it. this doesn't specifically force the courts to go along, but they've generally followed the advice of the board so far. this doesn't apply to "distribution," defined as uploading - that's considered a violation. i myself do not consider distribution to be defined as a passive act, and that's what happens on a p2p, and while others feel the same way they don't represent record compnaies at copyright negotiations.

meanwhile none of this has been tested in court and judges have the last word, but basically until they do, downloading is legal, uploading is questionable.
