Legislators Move to Fix Loophole in Law

The Connecticut General Assembly is moving quickly to fix a loophole in the definition of sexual assault.

Tuesday, the state Senate unanimously approved a change in the law to allow sexual assault charges to be brought even if a case doesn't involve direct physical contact.

Under current law, sexual assault charges require physical contact.

The loophole came to light after a horrifying case involving three male University of Connecticut students.

They were accused of ejaculating onto a female student's face as she slept in a dormitory last September. The men, who watched a pornographic video before assaulting the female student, are no longer students at UConn.

They were charged with disorderly conduct and public indecency, but could not be charged with sexual assault under present state law. Their criminal cases are still pending.

The bill is expected to be passed by the House and signed by Governor Rell.

This assault was bizarre and not one contemplated when assault laws were written. Now, if there is a similar case, prosecutors can file assault charges.
