Actually I think the solution would be to spoof a DRM tag where there was none before. The necessary utility would actually have to generate a fake certificate rather than strip it. This way an "illegimate" MP3 file will be playable in a next generation iPod, because without that tag the iPod's gonna reject the file. This is because Tompson will only sell MP3 licences to companies that comply with the DRM requirments, so only certified files will be playable in certified players.
