I think that would be a bit drastic test of the letter. I do think, however, that it is a volley to put the ball back into their court. This isn't a way to avert violating copyright, only a little defense on behalf of the "little" guy.
PS. I do sense a bit of sarcasm in your post, but I believe this letter would have a bit more weight than the Napster version they feably tried to use.
