It's a good article and he's basically right, but he doesn't really explain his flat fee model except to compare it to a theme park. What exactly is he proposing?

It is hard to guess the exact implementation details he has in his mind; he will probably elaborate them in the MusicAlly seminar referred to in the Register article. Anyway, I think the basic formula is pretty clear: to be an attractive commercial alternative to free services you need to provide the same stuff in large quantities, good quality and with comfort and convenience of access. Instead of paying to lawyers for harassing people, invest in bandwidth, large cataloques, good search and suggestion systems etc. Prepare to dump the business models based on control of scarcity and learn to make a living within a luxury economy.
